Welcome to the ieatlocally.com Web Site (the "Web Site"). The following Terms of Service (“TOS”) contain the terms and conditions that govern your use of the Web Site and the ieatlocally.com Service (as defined below). These TOS describe your rights and responsibilities and what you can expect from the ieatlocally.com service. Your use of the Web Site constitutes acceptance of these TOS. Please read this document carefully before accessing or using the Web Site.

I Eat Locally reserves the right to add, delete and/or modify any of the terms and conditions contained in this Terms of Service, at any time and in its sole discretion, by posting a change notice or a new agreement on the Web Site. You are therefore responsible for regularly reviewing these TOS. In the event of substantive changes to this TOS, you may be notified by email. If any modification is unacceptable to you, your only recourse is to not use the Web Site and the ieatlocally.com Service. Your continued use of the Web Site following posting of a change notice or new TOS on the ieatlocally.com web site will constitute binding acceptance of the changes.

1. Here’s how it works:

Choose a restaurant gift certificate from the available list. After adding gift certificates to your shopping basket, proceed to the "checkout" and fill out the requested information to complete your purchase. Your gift certificates will be available for printing immediately after checkout. If you are unable to print them at checkout you will also be emailed instructions on how to print your certificates at a later date.

2. These certificates are processed for I Eat Locally by InstaGift LLC. Your credit card will be charged by "InstaGift.com".
3. There are a few rules and restrictions that we would like you to be aware of before purchasing.
• Valid for dine-in only, not valid on take-out items
• Limit 1 gift certificate per visit, per party, per month, per restaurant (this means that you are not allowed more than one gift certificate per table, and you are not allowed to use our gift certificates for the same restaurant more than once within that current month
• Not valid with any other discount, gift certificate, promotions, third party gift certificates, or pricing specials offered (i.e. happy hour specials, special discounted menus, etc.)
• Use of gift certificates for alcoholic beverages is at the sole discretion of the merchant (please check with the restaurant first)
• Cannot be used for taxes, tips, or prior balances
• No cash value for gift certificates and no cash back upon redemption
• The gift certificates are uniquely numbered for verification at the time of use via a secure website
• Gratuity is not included, so please don’t forget to TIP on the undiscounted total. The restaurant reserves the right to add gratuity prior to the discount.
• Gift certificates expire one (1) year from date of purchase
4. For those hesitant to make credit card purchases over the internet, rest assured that all operations are taking place on a secure server. Your card information is encrypted and is processed immediately. 5. Although we have discussed in detail the sale of these certificates with every owner of every included restaurant, and they have all agreed to the terms and conditions in writing, it is possible that you may run across a server who seems unfamiliar with the system. If this happens, don't worry and please be patient…all they need to do is check with the owner or manager to verify. That said, we do not expect there to be any problems at all, the servers should already be familiar with the gift certificate program.
6. 30% of all gift certificate sales for the given month will be donated to a local charity, listed on the “local beneficiaries” page. This payment will be made within 60 days from the last day of the current month.
7. Termination. InstaGift.com or I Eat Locally may suspend or terminate your use of the Web Site or ieatlocally.com service if it believes, in its sole and absolute discretion, that you have breached a term of these TOS.
8. Purchases
• Use of Credit Card. If you wish to purchase products or services described in this Web Site, you may be asked to supply certain information, including credit card or other payment information. By providing such information, you represent and warrant that it is accurate, complete, and current. By making any such purchase, you agree to pay all charges (including shipping and handling charges) incurred by users of your credit card or other payment mechanism at the prices in effect when such charges are incurred. You are responsible for paying any taxes applicable to such purchase.
• Right of Refusal. Ieatlocally.com reserves the right to refuse any order for any reason. Orders may be delayed or canceled if ieatlocally.com is not given completely accurate information and/or is unable to contact the person who has placed the order and/or is the primary cardholder for the order.
